As of 3 October 2024, there have been significant changes to the NDIS funding rules. If you’re a service provider or support NDIS participants, it’s crucial to understand these updates and how they affect you.
Transition Period Ending Soon
The new NDIS rules came into effect on 3 October 2024, with a 30-day transition period allowing providers to adapt to the changes. This transition period will end on 1 November 2024. It’s essential to ensure your compliance with these new rules by this date.
What Has Changed?
From 3 October 2024 onwards, NDIS participants and their authorised representatives can:
Only spend NDIS funding on supports and services listed as approved NDIS supports.
No longer use NDIS funding for items or services categorised as non-NDIS supports.
The approved and non-approved lists are available on the NDIS website at What does NDIS fund?. Regularly checking these lists is essential to maintain compliance.
Impact on Providers and Plan Managers
From 2 November 2024, once the transition period ends, providers and plan managers must ensure that they are only claiming NDIS funds for approved supports. Incorrect or repeated claims for non-NDIS supports may lead to further actions, such as raising a debt against the provider.
Replacement Supports
There are also changes in how replacement supports are handled. These approved non-NDIS supports can only replace existing NDIS supports in specific circumstances where they lead to the same or better outcomes and provide equal or better value for money.
Providers should not offer or provide replacement supports unless the participant has obtained approval in advance. Replacement supports cannot be claimed retrospectively.
Stay Informed and Up-to-Date
The NDIS is regularly updating its website with the latest information to help providers remain compliant. We recommend:
Familiarising yourself with the updated lists of approved and non-approved supports on the What does NDIS fund? page.
Reviewing operational guidelines and updated materials on the Changes to NDIS legislation page.
Registering for an upcoming information session for providers to gain more clarity on these changes.
Additionally, Easy Read and Auslan translations are available, and common questions can be found on the Frequently Asked Questions about legislation page.
